Mobile Phones in cars

It is illegal to drive a vehicle while using a hand-held mobile phone.
Using a hand-held mobile phone is illegal even when you are stopped at traffic lights.

Penalties:

  • NSW: Three demerit points and a fine
  • QLD: Three demerit points and a $300 fine
  • SA: Three demerit points and a fine
  • Vic: Three demerit points and a fine
  • WA: Three demerit points and a $250 fine

It is illegal to use a hands-free phone while driving, if it causes you to lose proper control of your vehicle

Penalties:

  • NSW: Three demerit points and a fine
  • QLD: Three demerit points and a $300 fine
  • SA: The offence of driving without due care or dangerous driving.
  • Vic: Three demerit points and a fine
  • WA: ?
